These Terms of Service form a legally binding agreement between you and Hermosa HQ Ltd (“Hermosa”, “we”, “us”, or “our”) governing your use of our website and the purchase of products from us.

By accessing our website, placing an order, or using any related services, you agree to be bound by these terms.

If you do not agree with these terms, you should not use our website.

2. Definitions

Carrier means a third-party delivery provider contracted by us.

Content means all text, images, graphics, videos, branding, downloads, and other materials published on our website.

Goods means any products offered for sale by Hermosa.

Our Website means any website, webpage, or digital platform controlled or operated by Hermosa HQ Ltd.

Posting means uploading, publishing, transmitting, or displaying content on our website or associated platforms.

3. Interpretation

3.1 These terms apply to all sales and supplies of Goods by Hermosa HQ Ltd and override any conflicting terms proposed by you unless agreed in writing.

3.2 References to persons include individuals, companies, partnerships, and organisations.

3.3 Headings are for convenience only and do not affect interpretation.

3.4 These terms are drafted and interpreted in the English language only.

3.5 We may transfer or assign our rights and obligations under these terms where reasonably necessary. This will not affect your statutory rights.

4. Our Contract With You

4.1 These terms, together with our policies referenced on this website, form the entire agreement between you and Hermosa HQ Ltd.

4.2 If you place an order on behalf of another person or business, you confirm you have authority to do so.

4.3 Product availability, pricing, specifications, and promotions may change at any time.

4.4 We reserve the right to refuse orders, cancel transactions, limit quantities, or decline delivery to locations we do not service.

5. Acceptance of Orders

5.1 Your order constitutes an offer to purchase Goods from us.

5.2 Acceptance occurs only when the Goods are dispatched.

5.3 Prior to dispatch, we may refuse or cancel orders for reasons including but not limited to:

  • stock unavailability

  • pricing errors

  • suspected fraud

  • payment verification issues

  • shipping restrictions

  • incorrect address information

5.4 If products are unavailable after an order is placed, we may offer substitute products, partial fulfilment, or cancellation options.

6. Pricing & Payment

6.1 Prices displayed on our website include Irish VAT where applicable unless otherwise stated.

6.2 Delivery charges and any applicable fees are displayed during checkout before payment is completed.

6.3 Payments are securely processed through trusted third-party providers including Stripe, PayPal, Shopify Payments, or other authorised payment providers.

6.4 Hermosa HQ Ltd does not store complete payment card details.

6.5 In the event of pricing or product information errors, we reserve the right to correct such errors and contact you before dispatch.

6.6 Refunds due to you will be processed as soon as reasonably practicable and within any timeframes required under applicable consumer law.

7. Delivery

7.1 Unless otherwise agreed, Goods will normally be delivered within 30 days of order confirmation.

7.2 Delivery is made to the address supplied during checkout. Customers are responsible for ensuring address details are accurate and complete.

7.3 We may deliver orders in separate instalments where necessary.

7.4 Risk in the Goods passes to you once you, or a person nominated by you (other than the Carrier), take physical possession of the Goods.

7.5 Ownership of the Goods remains with Hermosa HQ Ltd until payment has been received in full.

7.6 Delivery dates and times are estimates only and are not guaranteed.

8. International Orders, Taxes & Customs

8.1 Orders delivered within the European Union should not incur additional customs duties.

8.2 Orders delivered outside the European Union may be subject to import duties, taxes, customs fees, or local regulations which are the responsibility of the customer.

8.3 Customers are responsible for ensuring Goods may be legally imported into their destination country.

9. EU Consumer Right to Cancel (14-Day Cooling-Off Period)

9.1 If you are a consumer located within the EU or EEA, you may cancel eligible orders within 14 days of receiving the Goods without giving a reason.

9.2 To exercise this right, contact support@hermosahq.ie within 14 days of delivery.

9.3 Returned Goods must be sent back within 14 days of cancellation notification and handled with reasonable care.

9.4 Unless Goods are faulty, damaged, or incorrectly supplied, return shipping costs are the responsibility of the customer.

9.5 Refunds will be processed in accordance with applicable consumer protection law.

9.6 Certain products may not qualify for return where they have been opened, contaminated, partially used, customised, or otherwise excluded under applicable law.

9.7 Your statutory consumer rights remain unaffected.

10. 90-Day Satisfaction Guarantee

10.1 In addition to your statutory rights, Hermosa may offer a separate 90-day satisfaction guarantee on selected products.

10.2 Conditions, exclusions, and eligibility requirements for this guarantee are set out in our Returns & Refunds Policy.

10.3 This guarantee does not limit or replace your legal rights under Irish or EU consumer law.

11. Faulty, Damaged, or Incorrect Items

11.1 Customers should inspect Goods upon delivery.

11.2 If Goods are faulty, damaged, defective, or incorrectly supplied, please contact us promptly at support@hermosahq.ie.

11.3 Where required under applicable law, we will repair, replace, refund, or otherwise resolve the issue at no additional cost to you.

12. Product Use & Safety

12.1 Hermosa products are intended for automotive detailing and vehicle care purposes only.

12.2 Products must be used strictly in accordance with supplied instructions and safety guidance.

12.3 Customers are responsible for testing product suitability before full application.

12.4 Hermosa HQ Ltd accepts no liability for damage resulting from misuse, incorrect application, improper storage, incompatible surfaces, or failure to follow instructions.

12.5 Relevant Safety Data Sheets (SDS) and product safety information are available on this website for applicable products.

13. Website Accounts

13.1 You are responsible for maintaining the confidentiality of your account credentials.

13.2 You accept responsibility for activities occurring under your account.

13.3 You must notify us immediately of any unauthorised use or security breach.

14. Acceptable Website Use

14.1 You must not:

  • post unlawful, abusive, defamatory, misleading, or infringing material

  • impersonate another person

  • interfere with website security or operation

  • scrape, copy, reproduce, or misuse website content

  • introduce malicious software or harmful code

14.2 We reserve the right to remove content or suspend access where necessary.

17. Warranties & Liability

17.1 Nothing in these terms excludes or limits liability for:

  • death or personal injury caused by negligence

  • fraud or fraudulent misrepresentation

  • breaches of consumer rights that cannot lawfully be excluded

17.2 Nothing in these terms affects statutory consumer rights under Irish or EU law.

17.3 Subject to the above and to the fullest extent permitted by law:

  • we are not liable for indirect or consequential losses

  • our total liability relating to any order or claim shall not exceed the amount paid for the relevant Goods

17.4 Website information is provided on an “as available” basis and may occasionally contain inaccuracies or interruptions.

18.1 We may contact you using the email address or telephone number you provide.

18.2 Electronic communications may satisfy legal communication requirements.

19. Events Outside Our Control

19.1 We are not responsible for delays or failures caused by events beyond our reasonable control including:

  • courier disruptions

  • customs delays

  • industrial disputes

  • natural disasters

  • internet outages

  • government actions

  • supply chain interruptions

19.2 We will take reasonable steps to minimise disruption where possible.

20. Complaints & Disputes

20.1 Complaints should be directed to support@hermosahq.ie.

20.2 Consumers within the EU may also have access to local dispute resolution mechanisms under applicable consumer protection laws.

21. Changes to These Terms

21.1 We may update these terms periodically to reflect legal, regulatory, or operational changes.

21.2 The version of the terms displayed at the time of checkout will apply to your order.

22. Governing Law

22.1 These terms are governed by the laws of Ireland.

22.2 If you are a consumer residing within the EU/EEA, you may also benefit from any mandatory consumer protections available in your country of residence.
